OFFICIAL ONLINE GAME RULES

1. ONLINE GAME DESCRIPTION: Each Online Game (the “Game”) consists of seven (7) musical categories (each a “Category”). Each Category will be a different musical genre, decade and style, as determined by Argyle Productions, Inc. ( Sponsor”) at its sole discretion. Each Category will contain one (1) song that will play for a pre-determined length of time, after which the song will stop and one blank line will be displayed on the screen for each missing lyric. In order to advance to the next Category, the online contestant (the “Contestant”) will be given a time limit of twenty (20) seconds to type in the correct missing lyrics to each song in each Category. If the Contestant does not provide the correct missing lyrics, the Game will conclude and Contestant must start over from the first Category.

2. AUDITION VIDEO: If the Contestant provides the correct missing lyrics to any/each of the seven (7) Categories, the Contestant will be given the option to upload a personal “audition” video through the Contestant’s personal webcam (the “Video”) in which the Contestant will sing the lyrics to the respective song from the Category most recently completed. In order for a video to be uploaded to the system, it must be in one of the following file formats: .3GP, .AVI, .DV, h.264, .FLV, .MPEG2, .MPEG4, Quicktime, .WMV . Additionally, the video file must be no larger than 100 Megabytes in size. The Contestant agrees to use one of the following supported operating systems: Windows XP, Windows XP with Service Pack 2, Windows 2000, Mac OS X v10.2 or later; use of an operating system other than those supported means that the Contestant cannot hold FOX responsible for anything that happens as a result of using said operating system. The Contestant agrees to use one of the following supported web browsers: Windows: Internet Explorer 6 or 7, Firefox v1.5 or greater; Mac: Safari, Internet Explorer, or Firefox v1.5 or greater. Use of a web browser other than those supported means that the Contestant cannot hold FOX responsible for anything that happens as a result of using said browser. Upon successful completion of each Category, the Contestant will be prompted to enter personal identification and contact information (e.g., full name, age, telephone number and e-mail address) prior to uploading the Video. The Contestant will then have an unlimited amount of time to upload the Video. Every eligible Video posted will be forwarded to the casting team (“Casting”) of Don’t Forget the Lyrics! (The “Series”) and such Contestant will be given consideration by Casting to be a potential contestant on the Series. However, the posting of a Video by a Contestant does not guarantee that he or she will be selected as a Contestant on the Series. If a Contestant’s Video is selected by Casting to proceed in the audition process for the Series, such Contestant will be contacted via phone and email by Casting. Each e-mail notification will also include an affidavit of eligibility and casting application (the “Application”). It will be mandatory for eligible Contestants between ages thirteen (13) and eighteen (18) to obtain parental consent on their Applications before proceeding further in the audition and casting process for the Series.

3. VIDEO SUBMISSIONS:

a. Every Video is submitted under the following terms and conditions: (i) all Videos become the sole property of Sponsor; (ii) Videos shall not infringe upon any third party trademark, copyright, or other intellectual property right; (iii) Videos shall not violate any third party right of privacy or publicity; (iv) Videos shall consist of Contestant singing only and no other identifiable persons, locations, logos or other third party content; and (v) Videos shall not contain any nudity, profanity, violence or other inappropriate or objectionable content. Every Contestant who submits a Video agrees to indemnify and hold harmless Sponsor, FOX Broadcasting Company (“FOX”) and their respective parents, subsidiaries and affiliated companies, from any claims, suits, losses, damages and expenses (including reasonable attorneys’ fees) that arise from any breach of the aforementioned conditions.

b. Every Contestant who submits a Video agrees: (i) his/her uploaded Video may be used by Sponsor in whole or in part for any purpose whatsoever without compensation; (ii) to grant to Sponsor the exclusive, irrevocable right and license to exhibit, copy, broadcast, reproduce, edit or otherwise exploit Video and/or any portions thereof, or assign to others the right to exploit Video without restriction, in any media throughout the universe in perpetuity; (iii) to execute and delivery any additional documents and releases that may be required by Sponsor upon request

4. DURATION OF THE GAME: The current cycle of the Game will last twelve (12) consecutive weeks starting Friday, May 30, 2008 and ending Friday, August 22, 2008.  Each consecutive week Sponsor will supply the Game with a new set of Categories and songs. Sponsor reserves the right at its sole discretion to shorten, extend, suspend, modify and/or cancel the Game (or any part thereof) at their discretion at any time without notice to Contestants.

5. ELIGIBILITY REQUIREMENTS: No purchase necessary to play the Game. Each Contestant agrees to be bound by the Official Rules  Employees, shareholders, officers, directors, agents, and representatives of Sponsor, FOX and their immediate family members and those living in their household, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity may play the Game but are not eligible to compete in the Series.

6. CONDITIONS: Video upload constitutes permission to use Contestant’s name, picture, likeness, and city and state of residence for purposes of trade, publicity or promotion for no additional compensation. All entry materials become the exclusive property of Sponsor and will not be acknowledged or returned. Submission of a Video constitutes irrevocable assignment to Sponsor of any and all rights to the Video including, but not limited to, copyright and all other intellectual property rights, except where prohibited by law. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
